Mental Health & Capacity Law

  • Anthony Fay is a member of the Independent Legal Representative’s Panel administered by the Mental Health Commission (MHC). He has represented people involuntraily detained under the Mental Health Acts in psychiatric centres for over 10 years.
  • Legal representatives have a fiduciary duty towards the service user and in particular to ensure that the highest standards are maintained in the provision of legal services and representation. Anthony further supports the view that respectful and empathetic relationships are required between people using mental health services and those providing them (including legal practitioners).
  • Extensive advocacy experience including representing clients before Mental Health Tribunals, Appeals to the Circuit Court, Habeas Corpus applications and Judicial Reviews heard before the High Court and the Supreme Court.
  • Anthony has made submissions to the Commission on the Future of Policing in Ireland regarding legislative, operational and administrative reform (January 2018)
  • The Gazette, Law Society of Ireland published his article entitled “Memphis on my Mind” (July 2018) which examines the interaction between Mental Health Service Users and the Police. See link below.
