The Workplace Relations Act 2015 provides for a range of changes to the bodies and procedures which deal with – The resolution, mediation and adjudication of industrial disputes and breaches of employment legislation . The Workplace Relations Commission (WRC) which has taken over the functions of the National Employment Rights Authority, the Labour Relations Commission (LRC), some of the functions of the Employment Appeals Tribunal (EAT) and the functions of the Director of the Equality Tribunal.

The principal of the firm Anthony Fay has extensive employment law and industrial relations experience. He has represented both employees and employers in Ireland and other jurisdictions on issues such as:

  • Unfair and constructive dismissal actions, breach of employment contract claims and judicial review of the dismissal of civil servants.
  • Health and safety issues including personal injuries as a result of workplace accidents, psychological injuries/stress arising from bullying and harassment.
  • Claims in relation to work related racial and sexual discrimination. The Workplace Relations Commission (WRC) now deals with all complaints of discrimination in employment and access to goods and services. These complaints were formerly handled by the Equality Tribunal.
  • Claims before the Labour Relations Commission under the Payment of Wages Act 1991.
  • Unemployment and redundancy rights.
  • Drafting contracts of employment and companies policies and procedures.
  • Part Time & Fixed Term Contracts

Recent Developments: 

The Employment (Miscellaneous Provisions) Act 2018 bans zero-hour contracts in general (with limited exceptions) and provides for minimum payments and banded hours. It also states that employers must provide employees with information on the 5 core terms of employment within 5 days of them starting work. It came into operation on the 4th March 2019.
